As the lone fall guy for the Civil War between the superheroes (which he ended, I might add, for the sake of the civilian population), Capt. America's death and the Presidential amnesty of everyone else on the "wrong" side of the war gives a dramatic denoument. However, I can see Tony Stark's guilt about sending his friend to the slammer while he becomes head of S.H.I.E.L.D. causing him to attempt to keep Rogers out of prison by doing the same thing he himself did during the "Armor Wars" when faced with legal action; faking a death and assuming a new identity.

A distinct possibility. Just so long as Steve Rogers doesn't step out of the shower and She-Hulk rolls over in bed and says "I had the strangest dream . . ."
