Do any of you know someone in San Diego with a license in the practice of
law, an interest in personal injury and a mean strike 10 miles wide?
Btw, this is the reason that Robin Roth wasn't on the radio yesterday
afternoon, and took "the afternoon off", so that she could be with her
husband as they try to reassemble his face.

Friday night my close friend Jim was attacked in Old Town. He was targeted
because of his black clothing and earring and called a "faggot Goth"
despite his being with wife, Robin, and another couple. Jim's assault was
unprovoked and can only be called a hate crime. He was severely beaten in
the face and has a long road of recovery ahead of him. One of the
assailants was caught and it unfortunately appears he is in the Navy. Jim
is looking to take action to the fullest extent of the law. If anyone can
offer further information, knows a witness, has any legal suggestions,
financial help ideas, or media avenues worth pursuing so that this
incident does not get swept under the rug they would be greatly appreciated.

The first initial reconstructive surgery went very well. The shattered
fragments of my eye socket were repaired, and the implantation of a
support plate and a titanium screw will insure that I will not look like
some eye recessed mutant when the swelling goes down. The nose may have
to be repaired in another procedure later. I'm on a constant IV which is
a cocktail of anti-inflamatories, anti-biotics, hydrators, vitamins, etc.
I stopped taking pain medication last night, though it still hurts a
little. I'd like to keep just enough pain to remind me that justice will
need to be served.
As many of you know, I was the victim of what can only be described as
a Hate Crime. Me, my wife, and another married couple that we went to
dinner with in Old Town San Diego found ourselves the target of 2 highly
intoxicated men between 25 to 35.
They were intoxicated and making a target of all around them. They
picked on a 13 year old boy calling him a faggot. They addressed my wife
and friends in an unacceptable manner, asking what is wrong with us and
denouncing us as freaks. They singled in on me and called me a faggot
Goth with an earring. They were full of hate and drink, and his breath
stunk of both as he shouted insults at me trying to solicit a
reaction. I gave him none...until he threatened the safety of a woman
only one third his weight...
Laura began to dial the police and was directly threatened with
destruction of her phone and physical assault should she dial. I
retorted that if they so much as touched her there would be severe
immediate consequences, and pulled my phone slowly from my side and began
to dial in full sight of the man that made the threat.
I was immediately struck several times with a fist, possibly ringed,
possibly with car keys in the hand. My phone went flying, but my
distraction from Laura gave her the opportunity to dial the
authorities. A small riot broke out as I found myself struggling with
my primary assailant and his brother who jumped in and continually struck
me in the face while I was down. I had control of the primary assailant
by the throat on my left side as I struggled with his brother to keep
from getting a full Brazilian mount on me. I was close to loosing
consiousness, but never did...by his 15th strike, my nose was broken, my
eye socket was shattered and my jaw was dislocated. I was bleeding from
multiple lacerations to my face and from my broken nose. The normally
peaceful street had been painted red.
My good friend Mark had managed to pull the primary assailant off me
and was in pursuit of him as he fled like a coward. Laura was also in
pursuit. Both suffered injuries from the assailants as they attempted
citizens arrest. A crowd of good citizens did jump in; thank you to the
uniformed marines who assisted and the young lady who provided me ice and
water and found me a chair.
Thank you very much to the Police Officers who arrived and filed a non
biased report based on the facts. Thank you to the EMT squad of Joe,
Lisa and the other gentlemen who took good care of me in my ride to Sharp
Hospital, who's staff were very accomodating.
Thank you to the vast amount of you who provided support in the form
of Phone Calls, E-mails, Visitations and kind words to those who know
me. It is very much appreciated. I cannot believe I had nearly 25
people drop by to give me support yesterday... I never knew I had so much
support.
If anyone knows anyone who was a witness to this event on Friday night
about 10pm in Old Town, please put them in contact with me.
I am pressing charges for felony assult and fully intend to pursue
civil action in the name of justice.
I may never look quite the same after this attack which was completely
without provocation, rhyme or reason. I will have scars and some
disfigurement. I may never feel quite the same way about my personal
safety or the safety of those around me.
I will not have fear, however. And I encourage all of you who have
ever found yourself a victim to live without fear, and pursue
justice. Know your rights, know your privileges, and enjoy them fully
without fear from those who would seek to rob you of your civil liberties
and freedoms. Ask questions of those who seek to make any infringements
upon your freedoms, and do not fear challenge to falsely assumed
authority when it presents itself. The law is for everone.
I will be seeking the most professional of attorney's for my pursuit
of justice. I will not seek settlement, but full restoration and damages
in accordance to my rights. If anyone knows a good one, some one who is
fair but viscious, I'd like their number as I intend to start my casework
this week.
I fully expect my pursuit of civil liability from my two assailants
will have some difficulties. I am informed that at least one of them is
in the Navy. I the deepest respect our armed forces, but the actions
that were commited are not that of an honorable serviceman. He has
dishonored himself and anyone else who wears a uniform.
He has commited a felony assult on a private citizen as an aggressor,
and I will seek to have him dishonorably discharged from the military,
and stripped of all rank.
Regardless of if his brother is military or not, I will be seeking the
maximum extent of prosecution criminally and civily. The primary
assailant tried to hurt me, the secondary tried to kill me, as it was a
result of his blows that I am hospitalized and have had to have
surgerys. No mercy was shown to me as I was beaten to a pulp on the
ground, I intend to show no mercy in my pursuit of justice and
restoration. I do not intend to settle.
This incident has re-installed in me the desire to educate and inform
people of their rights, and to illustrate injustice. It is with this
incident that I have been inspired to revive DARK EMPIRE PUBLICATIONS
which was dedicated to the examination of wrongs in our society and the
examination of the darker mindset in America's subcultures. Look for it
in October.
Again, I want to thank all of you for your continued
support. Special thanks to my beautiful wife, Mark, Laura and all those
who came to my bedside with kind words of encouragement, support and
advice. It is all taken to heart.
