That's mindblowingly horrible, BUT I think it'll die on appeal, which is where it's going. It's a county law, and the state will trump it. In a way it's a good thing; that way this state law can be overturned in state supreme court, which it wouldn't be if it were never challenged.

Sounds to me like they could have avoided trouble with a paternity test prior to filing for divorce. Once established that the child was not the husband's, the court would have had discretion to grant the divorce regardless of the pregnancy.

I can see where the law was probably developed to protect children from being born without any means of support, but bad laws are meant to be tested and rewritten via the appeals process. Laws that are written poorly (like this one) so that they can only be interpreted one way in a situation that was never forseen by the authors of that law, will eventually be fixed once they are proven to not work right.

The system eventually works, but only after it's proven to be broken.
